In the relationship between the hotelier and his guests who have booked directly with the hotelier and not through a travel agency or tour operator, the General Terms and Conditions for the Hotel Industry 2006 (AGBH2006) are of importance. The prerequisite for this is the verifiable agreement of these AGBH between the hotelier and the guest as part of the accommodation contract.
If the hotelier and the guest have not made any arrangements regarding the General Terms and Conditions, then, according to the Supreme Court, the AGBH can be used as a genuine custom and thus serve to interpret the contract. These then take precedence over the dispositive (mandatory) law of the General Civil Code (ABGB).
