General Terms and Conditions of Schlick 2000 Schizentrum AG, FN 34262k

These GTC apply between Schlick 2000 Schizentrum AG (hereinafter referred to as Schlick) and the purchasers of lift tickets, goods or other services (hereinafter referred to as customer).

Card networks
The individual services to which the "Ski + City Pass" or "Stubai Skipass" or other card group offers such as the "Freizeitticket Tirol" or the "Snowcard Tirol" entitle the holder are provided by legally independent companies. The entrepreneur selling the card acts only as an agent for the other entrepreneurs. Therefore, only the entrepreneur in whose responsibility or sphere the incident or damaging event occurred or in whose sphere the event giving rise to liability occurred is obliged to provide the individual services and to compensate for damages in the event of any incidents.

Tariff conditions
The tariffs set for the respective year apply. These are displayed at the cash desk and can be seen on the homepage www.schlick2000.at.

For the purchase of preferential cards, the respective proof must be provided (children, youths and seniors with ID with date of birth, disabled persons with disability certificate with at least 60% and ski instructors with ID with valid ISVI or ISA brand). Cards are not transferable.

Opening hours
The respective opening times (start of season, end of season, closing times) are not fixed dates, because the actual operating times depend on the weather, technical defects or, if necessary, measures ordered by the authorities (such as closures).

Transport of bicycles and other bulky sports equipment
The transport of bicycles and other bulky sports equipment (e.g. hang gliders) is not included in the ticket price and must be paid for separately according to the respective tariffs.

Misuse
The card is personal (valid only with photo) and non-transferable. A photo of each customer is taken at the first entry, which is deleted after the expiration of the validity. The customer must carry the card and present it at any time upon request together with an official photo ID. Attempted or actual misuse of the card and refusal to show the card together with the photo ID will result in immediate withdrawal of the card without compensation and blocking without entitlement to replacement or refund.

Loss and damage
In case of loss or damage of season or multi-day tickets, a blocking number voucher (handed out at the time of purchase) must be presented. The lost card will be blocked (manipulation waiting time 24 hours). When a new replacement card is issued, a gross fee of € 30.00 will be charged for adults and € 15.00 gross for children (plus € 2.00 gross for the keycard). In the event of damage, a gross charge of € 2.00 will be levied to replace the blank card.

Forgetting the card
Transport is not possible without a card.

Death, illness or accident of a customer
In case of accident or prolonged illness (with a health impairment of at least 4 weeks) or in case of death, the customer is entitled to the following refund amounts according to the following card types:

Schlickschipass - reimbursement in case of illness, sports accidents and death

SKI plus City cards - refund only in case of sports accidents and death.

As a gesture of goodwill, can be refunded a second card in the case of a child, because of the necessary care or the joint journey home.

Calculation and basis of refund:

One-day tickets are not refundable.

In case of an accident, the ski pass must be deposited immediately at one of our ticket offices. Days of use are considered to be the days from issuance to deposit of the ski pass.

Proof of illness or accident must be provided in the form of a medical certificate from a doctor resident in Fulpmes or Neustift and can be provided the next day. No refund will be made without a medical certificate.

In case of death, the day of death is considered the day of deposit.

In the case of multi-day tickets, the days not used will be refunded in proportion to the days used.

  • e.g: Ski pass for 6 days: purchase price € 228.50. If an injury occurs on the second day and the ski pass is deposited, the price of a two-day pass (€ 84.50) will be deducted from this. The customer will be refunded € 144,00.
  • e.g: Wahlabo tickets

Purchase amount divided by the possible ski days. 3 out of 4 purchase price divided by 3 = calculated daily price, 1 day used, 2 days are refunded).

For Schlick 2000 annual passes the following refund applies:

  • Deposit until 30.11. 80% of the ticket price;
  • Deposit until 31.01. of the following year 40% of the ticket price;
  • Deposit until 28.2. of the following year 20 % of the ticket price;

The refund request must be submitted to our ticket offices.

Refund in case of closure by authorities or force majeure.
In the event of closure of the entire ski area by the Austrian authorities in accordance with Covid-19 laws or regulations, the days of the card that cannot be consumed as a result will be refunded pro rata temporis for annual cards at 0.775% per day of the winter season card price. The percentage is calculated from an average of 129 winter season days.

In the case of multi-day tickets, the days that cannot be consumed will be refunded in proportion to the total ticket price.

The same regulation applies in case of official border closure or travel warning in connection with Covid-19 for our region by the respective country of origin. If the season ticket has been used at least once during the period of the above-mentioned border closure or travel warning, or if there is an exemption that allows the season ticket to be used, any claim for a refund will expire.

Refunds will be processed at the end of the winter season from 1.5. in our office.

In the sense of the "fair-use" idea, the customer will not receive a refund if he/she used the season ticket for at least 20 admissions during the period of validity.

Partial closure of facilities due to low frequency of use as a result of the pandemic
In the event of low usage frequencies at Schlick due to a pandemic, we are entitled to take individual or several lifts out of operation. As the customer still has the possibility to use a part of the offered services, he is not entitled to a proportional refund in this case.

Card network
In the case of ticket associations of several cable car companies, the regulations published for each of these apply.

The respective member of a card association is liable and warrants exclusively for incidents arising from or during the operation and use of the cable cars and lifts, as well as slopes and leisure facilities in whose area the incident occurred. The company Schlick is only liable for incidents in its skiing area.

Liability of the Schlick Company
The Schlick Company is liable to the customer for any claims for damages only in the case of intent and gross negligence, except in the case of personal injury.

Other
In all other respects, the conditions of carriage and tariff regulations of the individual facilities as posted shall apply.

Austrian law applies with the exception of the regulations of Austrian international private law. The applicability of the UN Convention on Contracts for the International Sale of Goods is also excluded.

Driving on, entering or using closed facilities is prohibited and punishable by law. Violations may result in the withdrawal of the ski pass without replacement as well as liability and criminal consequences.

From the last control run, immediately after the last ascent, the ski slopes and ski routes are closed due to, among other things, the dangers arising from maintenance work (use of snow groomers, winches, snow guns, exposure of cables and hoses, work on fences and guiding equipment, etc.). There will be no hazard protection during these closure times. Instructions given by Schlick employees in the interest of avoiding hazardous situations must be followed without restriction.

FIS slope rules
The FIS rules apply to all skiers and snowboarders. Anyone who violates the rules and causes an accident may be held liable for the consequences under civil and criminal law.

DECLARATION ON THE OBLIGATION TO INFORM (DATA PROTECTION DECLARATION)
The protection of your personal data is of particular concern to us. We therefore process your data exclusively on the basis of the legal provisions (DSGVO, TKG 2003). In this data protection information, we inform you about the most important aspects of data processing within the scope of our website.

Contact with us
If you contact us by form on the website or by e-mail, the data you provide will be stored by us for 6 months for the purpose of processing the request and in case of follow-up questions. We will not pass on this data without your consent.

Data storage
Please note that for the purpose of access control, a reference photo of the lift ticket holder is taken the first time he/she passes through a turnstile equipped with a camera. This reference photo is compared by the lift personnel with the photos taken each time the lift card holder passes through a turnstile equipped with a camera. The reference photo is deleted immediately after the expiration of the validity of the lift ticket, and the other photos are deleted at the latest 30 minutes after the respective passage through a turnstile. It should be noted that it is also possible to purchase lift tickets that are technically configured in such a way that no photo is taken when passing through the turnstile, but in this case random checks by the lift personnel must be expected.

We would like to point out that for the purpose of a simpler shopping process and for the later processing of the contract, the IP data of the connection owner are stored by the webshop operator within the framework of cookies, as well as the name, address, date of birth and photo of the buyer.

The data provided by you is necessary for the fulfillment of the contract or for the implementation of pre-contractual measures. Without this data we cannot conclude the contract with you. No data is transferred to third parties, with the exception of the transfer of credit card data to the processing banking institutions / payment service providers for the purpose of debiting the purchase price, further with the exception of the transport company / shipping company commissioned by us for delivery of the goods, as well as with the exception of data transmission to the companies that carry out the technical and financial processing of billing, including the entire card network systems, as well as with the exception of data transmission to our tax advisor to fulfill our tax obligations.

After termination of the purchasing process, the data stored by us will be deleted. In the event of the conclusion of a contract, all data from the contractual relationship will be stored until the expiry of the retention period under tax law (7 years). The data processing is based on the legal provisions of § 96 para 3 TKG and Art 6 para 1 lit a (consent) and / or lit b (necessary for the performance of the contract) of the DSGVO.

It is pointed out that for the purpose of access control, a reference photo of the customer is taken when passing through a turnstile equipped with a camera for the first time. This reference photo is compared by the staff of the partners and partner companies with the photos taken at each subsequent passage through a turnstile equipped with a camera or with the photo stored with the respective card. The reference photo is deleted immediately after the expiration of the validity of the lift or access card on the same day, the other photos at the latest 30 minutes after the respective passage through a turnstile.
